Public Terms of Service
About these terms
A-PAX Imaging, Inc. (“A-PAX”) operates the A-PAX Imaging Platform: a hosted medical imaging storage, routing, and viewing service for healthcare organizations and the authorized dealers who support them.
These public Terms summarize how the apaximaging.com and pacs.apaximaging.com websites and the platform sign-in surface may be used by visitors. The detailed contractual terms that govern any customer’s use of the A-PAX Imaging Platform — including the Services Agreement, Business Associate Agreement, and applicable Order Form — are presented to and agreed by each organization during onboarding, and remain accessible to that organization’s administrators after sign-in at /app/settings/legal/.
Who can use the platform
The A-PAX Imaging Platform is invitation-only and is not available for public self-signup. Access is established through a private invitation issued to an organization or dealer expressing interest, followed by a guided onboarding process. Sign-in is reserved for invited Authorized Users acting on behalf of an A-PAX customer organization or an authorized A-PAX dealer.
Acceptable use of public surfaces
Visitors to apaximaging.com and pacs.apaximaging.com agree not to:
- use the websites for any unlawful purpose or in violation of any applicable law or regulation;
- attempt to gain unauthorized access to the platform, other accounts, or A-PAX systems;
- interfere with or disrupt the integrity or performance of the websites or the platform;
- reverse engineer, decompile, or attempt to derive the source of the platform;
- upload or transmit malicious code, viruses, or content designed to damage or interfere with the platform;
- use automated scripts or tools to access the websites in a manner that imposes an unreasonable load on A-PAX infrastructure.
A-PAX reserves the right to suspend or terminate access immediately if it reasonably determines that a visitor or user is in material violation of these terms.
Inquiry submissions (“Interested in A-PAX?”)
Information you submit through the public inquiry form on apaximaging.com or the sign-in page is used by A-PAX to evaluate and respond to your interest in the platform. Submissions are received by A-PAX operations and are not used for marketing communications or shared with third parties unrelated to evaluating your inquiry.
Clinical responsibility
The A-PAX Imaging Platform provides data storage, routing, and viewing functionality only. A-PAX does not provide medical advice, diagnosis, treatment recommendations, or clinical decision support. Customer healthcare professionals are solely responsible for the interpretation of medical images, clinical decisions, diagnostic conclusions, and patient care.
No warranty on public surfaces
The websites are provided on an “as is” and “as available” basis. A-PAX disclaims all implied warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, with respect to the public websites. Warranties specific to the platform itself are set out in the Services Agreement entered into with each customer organization.
Intellectual property
The A-PAX Imaging Platform, A-PAX brand, and associated trademarks, software, documentation, and content are the property of A-PAX Imaging, Inc. Nothing on the public websites grants any visitor a license to use A-PAX intellectual property except as explicitly authorized in writing.
Governing law
These public Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles, except where preempted by federal law. The contractual terms governing customer use of the A-PAX Imaging Platform are set out in the Services Agreement.
